These Terms of Service govern your use of the Resilient Aging Health website, free challenges, memberships, coaching programs, educational resources, online community, and related services.
By accessing the website, registering for a challenge, purchasing a program, or using any Resilient Aging Health service, you agree to these Terms.
1. Business Information

2. Services Provided
Resilient Aging Health provides health, fitness, wellness, healthy-aging, mobility, exercise, nutrition-education, accountability, and lifestyle-coaching services.
Services may include:
Free wellness challenges
Group coaching
Exercise and mobility programming
Educational materials
Nutrition education
Goal setting and accountability
Live group question-and-answer sessions
Online community access
Premium private coaching
VIP private coaching
Specific services and benefits may vary according to the program purchased.
3. Not Medical or Rehabilitation Treatment
Resilient Aging Health provides coaching and education. Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Although the company is operated by a licensed occupational therapist, participation does not establish a therapist-patient relationship and does not constitute occupational therapy, physical therapy, medical treatment, medical nutrition therapy, mental-health treatment, or emergency care.
Information provided through the website, challenges, programs, community, emails, videos, and coaching sessions should not replace care from a physician or other qualified healthcare professional.
4. Health and Safety Responsibilities
Before beginning an exercise, nutrition, or wellness program, participants should consult a qualified healthcare professional when appropriate.
You agree to:
Provide accurate and complete health information
Disclose relevant medical conditions, injuries, symptoms, medications, or physical limitations
Participate only within your abilities
Follow safety instructions and exercise modifications
Stop any activity that causes pain, dizziness, faintness, chest discomfort, unusual shortness of breath, or other concerning symptoms
Seek appropriate medical or emergency care when needed
Call 911 or seek emergency medical care for an emergency. Resilient Aging Health does not provide emergency monitoring or emergency response services.
Resilient Aging Health may decline, pause, or discontinue services when a participant’s needs appear to exceed the appropriate scope of the program.
5. Assumption of Risk
Exercise and physical activity involve inherent risks, including soreness, falls, strains, sprains, fractures, cardiovascular events, aggravation of existing conditions, and other injuries.
By participating, you knowingly and voluntarily accept the risks associated with exercise, physical activity, wellness coaching, and implementing educational recommendations.
A separate informed-consent and liability-waiver agreement may also be required before participation.
6. Eligibility
Participants must be at least 18 years old and legally capable of entering into a binding agreement.
You may not participate on behalf of another person unless authorized by Resilient Aging Health.
7. Free Challenge
The 14-Day Wellness Challenge is provided for educational and introductory purposes.
Participation in the challenge does not guarantee admission into a paid program and does not guarantee any particular health, fitness, weight, strength, or wellness result.
Challenge participants remain responsible for determining whether each activity is appropriate for them.
8. Membership Pricing and Automatic Billing
Initial Enrollment Month
The first month of the Resilient Aging Health Membership costs $200.
The initial month may include assessment, onboarding, goal development, starting-program guidance, and access to membership resources.
Ongoing Membership
Beginning with the second month, membership costs $150 per month.
YOUR MEMBERSHIP WILL CONTINUE AND YOUR PAYMENT METHOD WILL BE CHARGED $150 EACH MONTH UNTIL YOU CANCEL.
You authorize Resilient Aging Health and its payment processor to charge the payment method provided at enrollment.
Any applicable taxes or separately disclosed processing charges may be added.
9. Membership Cancellation
You may cancel your monthly membership before your next billing date by:
Using the cancellation option available through your account, if provided; or
Emailing tylermears@proton.me
Cancellation prevents future renewal charges. Access may continue through the end of the billing period already paid.
Payments already processed are not prorated or refunded merely because the membership was unused, except where required by law or expressly approved by Resilient Aging Health.
Members are responsible for canceling before the next billing date.
10. Premium and VIP Coaching
Premium Coaching
The initial Premium Coaching price is $2,000 per month.
Includes weekly 1:1 call, individualized plan, nutrition plan, priority messaging/email, and access to group resources.
VIP Coaching
The initial VIP Coaching price is $3,000 per month.
Includes up to 3 weekly direct calls/video, direct phone/text access with boundaries, individualized fitness and nutrition plan, and priority support.
The exact services, payment schedule, communication access, private-session frequency, cancellation conditions, and scheduling policies will be disclosed before purchase and may also appear in a separate coaching agreement.
Premium and VIP coaching are limited-availability services.
Unless otherwise stated in writing, fees become non-refundable once the program begins, except where required by law. If Resilient Aging Health cancels a program without providing a reasonable alternative, the company may provide an appropriate prorated refund.
11. Scheduling and Missed Sessions
Private sessions must be scheduled through the approved scheduling system.
Sessions canceled or rescheduled with less than 24 hours’ notice may be forfeited unless an emergency or other approved circumstance applies.
Late arrival does not automatically extend the scheduled end time.
Specific scheduling rules may be included in the applicable coaching agreement.
12. No Guaranteed Results
Individual results vary.
Results depend on factors including:
Participation
Consistency
Effort
Health status
Medical conditions
Lifestyle habits
Nutrition
Sleep
Stress
Exercise history
Compliance with recommendations
Resilient Aging Health does not guarantee weight loss, muscle gain, improved laboratory values, prevention of illness, elimination of pain, continued employment, improved sports performance, or any other specific result.
Testimonials and examples describe individual experiences and do not guarantee that another participant will achieve similar results.
13. Nutrition Information
Nutrition information is general education designed to support healthy habits, energy, exercise participation, and weight management.
Resilient Aging Health does not provide medical nutrition therapy or replace a registered dietitian, physician, or other qualified healthcare professional.
Participants with medical conditions, food allergies, eating disorders, medication concerns, or specialized dietary needs should seek appropriate professional care.
14. Community Rules
Participants using the online community agree to:
Communicate respectfully
Protect the privacy of other members
Avoid harassment, discrimination, threats, or abusive conduct
Avoid giving unauthorized medical advice
Avoid advertising or soliciting other members without permission
Avoid uploading unlawful, harmful, or infringing material
Avoid sharing another member’s posts, images, or personal information outside the community
Resilient Aging Health may remove content or suspend community access when these rules are violated.
15. Recordings and Member Privacy
Group sessions may be recorded for member education and placed in the private resource library.
Participants will be informed when recording occurs.
Participants may keep cameras turned off or avoid sharing sensitive personal information during recorded group sessions.
Resilient Aging Health will not use a participant’s name, image, testimonial, health information, or identifiable story for public marketing without separate permission.
16. Intellectual Property
All programs, videos, written materials, exercise plans, graphics, templates, recordings, challenges, branding, and educational resources are owned by or licensed to Resilient Aging Health.
Participants receive a limited, personal, non-transferable license to use materials for their own participation.
Materials may not be copied, resold, reproduced, published, distributed, shared, taught, or used commercially without written permission.
17. User Content
You retain ownership of content you submit.
You grant Resilient Aging Health permission to store, display, and use submitted content only as reasonably necessary to operate the program, provide coaching, maintain the community, and deliver services.
You are responsible for ensuring that content you submit is accurate, lawful, and does not violate another person’s rights.
18. Email and Text Communications
By providing your email address, you agree to receive communications necessary to deliver services, including confirmations, reminders, challenge materials, onboarding information, and account notices.
Marketing emails may be discontinued using the unsubscribe option provided.
Text-message marketing will only be sent where appropriate consent has been obtained. Message and data rates may apply.
Unsubscribing from marketing messages does not prevent necessary service or billing communications.
19. Third-Party Services
Resilient Aging Health may use third-party providers for:
Website hosting
Payment processing
Scheduling
Email and text delivery
Community hosting
Customer relationship management
Video conferencing
Analytics
Use of those platforms may also be governed by their terms and privacy policies.
Resilient Aging Health is not responsible for temporary outages, security incidents, or service interruptions caused solely by third-party platforms beyond its reasonable control.
20. Privacy
Collection and use of personal information are governed by the Resilient Aging Health Privacy Policy.
Do not submit highly sensitive or emergency medical information through general website contact forms, social-media messages, or unencrypted email.
21. Suspension or Termination
Resilient Aging Health may suspend or terminate access for:
Nonpayment
Fraudulent activity
Harassment or abusive conduct
Unsafe participation
Unauthorized sharing of materials
Violation of these Terms
Needs exceeding the reasonable scope of the program
Termination does not automatically create a right to a refund.
22. Website Availability and Changes
Resilient Aging Health may update, modify, replace, or discontinue website content, program features, schedules, or technology.
Reasonable efforts will be made to avoid materially reducing already-purchased services without notice or an appropriate alternative.
The website and services may occasionally be unavailable because of maintenance, updates, technical problems, or events outside the company’s control.
23. Disclaimer of Warranties
To the maximum extent permitted by law, the website, programs, and materials are provided “as is” and “as available.”
Resilient Aging Health does not warrant that every service will be uninterrupted, error-free, appropriate for every individual, or guaranteed to produce a specific outcome.
24. Limitation of Liability
To the maximum extent permitted by law, Resilient Aging Health, LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services.
Except where prohibited by law, total liability for a claim will not exceed the amount the participant paid to Resilient Aging Health during the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold Resilient Aging Health harmless from claims, losses, or expenses arising from:
Your unlawful conduct
Your violation of these Terms
Your misuse of program materials
False or incomplete information you provide
Your infringement of another person’s rights
26. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Before filing a lawsuit, the parties agree to make a good-faith effort to resolve the dispute informally by written communication.
Unless applicable law requires otherwise, legal proceedings shall be brought in a court with jurisdiction in Davis County, Utah.
27. Changes to These Terms
Resilient Aging Health may update these Terms periodically.
The updated version will be posted with a revised “Last Updated” date.
Material changes affecting an active paid membership will be communicated when reasonably required.
Continued use of the services after an updated version becomes effective constitutes acceptance of the revised Terms, except where additional consent is legally required.
28. Severability
If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
29. Entire Agreement
These Terms, the Privacy Policy, applicable purchase information, and any separately signed client agreement constitute the agreement governing use of the services.
If a separately signed client agreement conflicts with these Terms, the separately signed agreement controls regarding the purchased coaching service.
